The Master onboard managed vessels has the ultimate authority on all matters affecting the safety of the ship, her crew, her cargo and the environment.
The Master shall, at all times, take all necessary steps and precautions to prevent accidents and to minimise the consequences of accidents that could affect the ship, her cargo and the environment and for this purpose the Master has all the necessary authority, on behalf of the Managers of the vessel.
No employee of the Managers, its agencies or agents shall have authority to override the Master's decisions in the performance of the responsibilities mentioned above. To the extent that any Policy or Procedure of the Managers or any representatives shall conflict with the ultimate authority of the Master, such Policy or Procedure shall be invalid.

Nothing in this Safety Management System removes from the Master his overriding authority and responsibility to make decisions, take any steps and issue any orders, whether or not they are in accordance with the contents of this Safety Management System, which he considers are necessary for the preservation of life, prevention of pollution or for the safety of the ship and to request the Company's assistance as may be necessary.

No commercial consideration should ever interfere with the ultimate authority of the Master and his responsibilities and decisions for the safety of the ship, her crew, her cargo and the environment.
